CDC Lawsuit Update: Judge Sets Court Date for September 1

In response to APT’s “Emergency Motion for Preliminary Injunction,” a judge in the Northern District Court of Georgia has set a court date for September 1 for oral arguments.

On July 15, 2021 Americans for Public Trust filed a Freedom of Information Act (“FOIA”) lawsuit against the Department of Health and Human Services (“HHS”) and the Centers for Disease Control (“CDC”) seeking production of redacted communications related to the guidance for reopening schools. On August 13, 2021, APT filed an “Emergency Motion for Preliminary Injunction” to which there has been no response from the agencies. Today, United States District Judge for the Northern District of Georgia, Eleanor L. Ross ordered HHS and CDC to follow an expedited schedule and file a response to APT’s motion by August 24, 2021.  She then set oral arguments on the motion for September 1, 2021. As parents and kids all over the country are trying to get back to school, transparency is needed now more than ever, and APT’s FOIA lawsuit hopes to find just how much influence politics has had on school reopenings.
